Terms and Conditions
By using our facilities, you agree to these Terms. Please read Sections 6 through 11 carefully.
Acceptance of These Terms
By entering our property, purchasing any wash, purchasing or redeeming a Washbook, using a Self-Serve Bay, or using a vacuum station, you agree to these Terms and Conditions (Terms). These Terms are posted at each pay station, at the entrance to the Automatic Wash, in each Self-Serve Bay, and at www.cypresswash.com.
If you do not agree to these Terms, do not use our facilities.
These Terms contain limitations on our liability, restrictions on the vehicles we accept, safety requirements for Self-Serve Bay use, and a requirement that damage claims be reported before you leave the property. Please read Sections 6 through 11 carefully.
Definitions
- Automatic Wash: The touchless automatic wash bay at either location.
- Self-Serve Bay: Any of the open, customer-operated wash bays with a high-pressure wand, foam brush, and timed controls.
- Single Wash: One Automatic Wash purchased at the posted price for immediate, one-time use.
- Tier: One of our three Automatic Wash service levels: Deluxe, Ultimate, or Premium.
- Washbook: A prepaid multi-wash pack for the Automatic Wash, purchased at a discount and redeemed one wash at a time.
- Timed Session: A period of Self-Serve Bay operation purchased in time increments.
- Wash Code: The redemption code we text to the mobile number you provide when you buy a Washbook. It is how Washbook washes are redeemed.
- Washbook Balance: The number of unredeemed Washbook washes associated with your Wash Code.
- Vehicle: The motor vehicle you present for washing, including anything attached to, mounted on, carried in, or towed by it.
Services and Pricing
3.1 Automatic Wash Tiers
Deluxe: $10.00 · Ultimate: $14.00 · Premium: $18.00. Each tier includes the specific services listed on the posted wash menu at the pay station. The posted menu at the point of purchase controls. Marketing materials, website descriptions, and printed flyers are for general information only.
3.2 Self-Serve Bays
Self-Serve Bays operate on a Timed Session basis at the rate posted at the bay, currently $3.00 for four (4) minutes. Additional time may be purchased during a session at the posted rate.
3.3 Prices Are Subject to Change
Prices, tier contents, time increments, and promotional offers may change at any time without prior notice. The price displayed at the pay station or bay meter at the time of purchase is the price that applies to that transaction.
3.4 Taxes
Posted prices include all applicable Texas state and local sales tax unless otherwise stated at the point of sale.
Washbooks
4.1 What a Washbook Is
A Washbook is a prepaid purchase of a fixed number of Automatic Wash services at a specific tier, bought at a discount to the single wash price. It is purchased for the buyer's own use. It is not a gift card, is not denominated in dollars, and carries no cash value.
4.2 Available Washbooks
Ultimate Wash Pack 6: $70.00 (6 Ultimate washes, $11.67/wash) · Ultimate Wash Pack 4: $42.00 (4 Ultimate washes, $10.50/wash) · Premium Wash Pack 6: $90.00 (6 Premium washes, $15.00/wash) · Premium Wash Pack 4: $54.00 (4 Premium washes, $13.50/wash). Washbooks are not offered at the Deluxe tier. Deluxe is available as a single wash only.
4.3 Automatic Wash Only
Washbook washes are redeemable exclusively at the Automatic Wash pay station. They have no value in, and cannot be applied to, Self-Serve Bays, vacuum stations, vending, or any other service.
4.4 How You Receive Your Washes
When you buy a Washbook at the Automatic Wash pay station, you will be asked to enter a mobile phone number. We then send a Wash Code by text message to that number. Your Washbook Balance is associated with that Wash Code. The Wash Code is how you redeem your washes. Keep the text message. If you do not provide a valid mobile number capable of receiving text messages, we cannot deliver a Wash Code.
4.5 How You Redeem
Return to the Automatic Wash pay station at either location, select the redeem option on the screen, and enter your Wash Code. One wash is redeemed per visit. Each redemption reduces your Washbook Balance by one. Washes may not be redeemed in bulk, stacked in a single visit, or transferred to a Self-Serve Bay session.
4.6 Text Messages: Consent and Delivery
By entering your mobile phone number at the pay station, you consent to receive a text message from us containing your Wash Code, together with any text messages necessary to service that Washbook. These are transactional messages relating to your purchase. Message and data rates may apply. You may reply STOP to opt out, but if you opt out you will not receive Wash Codes or replacement codes by text.
Text delivery depends on your wireless carrier and is outside our control. We do not guarantee delivery, delivery time, or that any message will not be blocked, filtered, or delayed. If you do not receive your Wash Code, call the customer service number for that location before you leave the property.
4.7 Keeping Your Wash Code Secure
Your Wash Code functions like cash. Anyone who has it can redeem washes from your Washbook Balance.
- You are solely responsible for keeping your Wash Code confidential.
- We are not responsible for washes redeemed by any person who enters a valid Wash Code, whether or not that person had your permission, and whether the code was shared, forwarded, overheard, or obtained from a lost or unlocked phone.
- We cannot restore, credit, or refund washes redeemed using a valid Wash Code.
4.8 Lost Codes and Changed Phone Numbers
If you lose your Wash Code or no longer have access to the phone number you provided, call the customer service number for either location.
- We may, at our sole discretion, resend a Wash Code to the original phone number, or issue a replacement code associated with a new number.
- We may require proof of purchase, such as the payment card used, the transaction date, or a receipt, before resending or reissuing a code.
- We may decline to reissue a code where we cannot reasonably verify the purchase or the requester.
- Where a replacement code is issued, the original code is void and any remaining balance moves to the replacement code.
4.9 No Expiration
Washbook washes do not expire. There is no expiration date, no dormancy fee, no maintenance fee, no inactivity fee, and no service fee of any kind applied to unredeemed washes.
4.10 No Membership, No Recurring Billing
A Washbook is a one-time purchase. It is not a membership or subscription. There is no monthly charge, no automatic renewal, and no recurring billing of any kind. We will not charge your payment method again unless you make a new purchase.
4.11 Tier Lock
- A Washbook wash cannot be downgraded to a lower tier, and no credit, refund, or partial value is issued if you use it for a lesser service.
- A Washbook wash can be applied toward a higher tier only by paying the posted price difference at the pay station, if that function is available at the terminal.
- Washbook washes cannot be split, combined, exchanged, or converted between tiers or between Washbooks.
4.12 Non-Refundable
Washbook purchases are final and non-refundable, including any unredeemed washes, except where a refund is required by applicable law, or where we determine, in our sole discretion, that a refund is warranted due to a billing error or duplicate charge.
4.13 Non-Transferable
Washbooks, Wash Codes, and Washbook Balances are non-transferable. They may not be sold, assigned, gifted, bartered, or moved to another person. Washbooks and Wash Codes may not be resold or offered for resale by any person or entity.
Sharing or distributing your Wash Code is a violation of these Terms. Because the pay station redeems any valid Wash Code that is entered, this prohibition is a restriction on you, not a technical control. It does not create any obligation on our part to detect, prevent, or reverse a redemption made with a valid code. See Section 4.7.
4.14 Permanent Closure
If we permanently close both locations, we will provide notice at each site and on our website and will honor unredeemed Washbook washes for a period of not less than thirty (30) days following that notice. If only one location closes, unredeemed washes remain fully redeemable at the remaining location.
Payment
- We accept Visa, Mastercard, American Express, Discover, and cash, subject to pay station and bay meter capability at the time of purchase.
- By providing a payment card, you authorize us to charge the full amount of the transaction.
- Chargebacks initiated on a validly rendered service or a validly issued Washbook may result in cancellation of the associated Wash Code and forfeiture of any unredeemed Washbook Balance, to the extent permitted by law.
Automatic Wash: Vehicle Eligibility and Restrictions
6.1 Clearance Limit
Maximum vehicle clearance is seven (7) feet. Do not enter if your vehicle, or anything mounted on it, exceeds seven feet in height or exceeds the posted width limits.
6.2 Vehicles We Do Not Accept in the Automatic Wash
DO NOT enter the Automatic Wash if your vehicle has or is any of the following. If you do, you enter entirely at your own risk and we accept no responsibility for any resulting damage:
- Pre-existing body damage, rust, corrosion, or previously repaired panels
- Loose, cracked, chipped, lifting, or missing trim, molding, emblems, weatherstripping, or badges
- Aftermarket or non-factory spoilers, light bars, wind deflectors, bug shields, or grille guards
- Bicycle racks, ski racks, cargo carriers, roof boxes, or anything mounted to the roof or hitch
- Non-retractable, oversized, or aftermarket antennas
- Vinyl wrap, decals, graphics, lettering, or any adhesive-applied covering
- Matte, satin, or textured paint finishes
- Paint applied, resprayed, or touched up within the last ninety (90) days
- Paint protection film or ceramic coating with lifting, bubbling, or peeling edges
- Cracked, chipped, or previously repaired windshields or windows
- Windows or sunroofs that do not fully close and seal
- Missing, loose, or damaged fuel door or fuel cap
- Convertible tops, soft tops, or removable roof panels
- Open, uncovered, or loaded truck beds, or unsecured cargo of any kind
- Tarps, ropes, straps, ladders, or exposed tools
- Mirrors, running boards, steps, or other components that are loose or not factory-installed
- Aftermarket suspension, oversized tires, or modifications affecting vehicle height or width
- Any trailer or towed unit of any kind. Trailers are not permitted in the Automatic Wash. Use a Self-Serve Bay.
6.3 Before You Enter the Automatic Wash
You are responsible for doing all of the following:
- Fully close all windows, sunroofs, moonroofs, doors, tailgate, hood, and trunk
- Retract or remove antennas
- Fold in or secure side mirrors as applicable
- Remove or secure all external accessories
- Confirm the fuel door and cap are closed and secure
- Remove or secure all loose items from the vehicle exterior and truck bed
- Follow all posted instructions, signals, and equipment prompts
- Keep all occupants inside the vehicle with hands and limbs inside at all times
Automatic Wash: Nature of the Service
Our Automatic Wash is a touchless system. It uses high-pressure water and cleaning solutions and does not use brushes or physical contact with the vehicle surface.
No specific cleaning result is promised or guaranteed. Touchless washing may not remove all road film, brake dust, tree sap, bug residue, tar, hard water spotting, bird droppings, industrial fallout, or heavily bonded contamination. Results vary based on vehicle condition, surface condition, existing wax or coating, and how long contamination has been present.
Self-Serve Bays
8.1 Customer-Operated Service
Self-Serve Bays are customer-operated. You control the equipment, you select the functions, and you apply them to your vehicle. You are solely responsible for how the equipment is used and for the results.
8.2 Clearance and Access
Maximum clearance is seven (7) feet. Trucks, RVs, and trailers are permitted in Self-Serve Bays if they fit within the posted clearance and bay dimensions. Do not enter a bay you do not fit in.
8.3 Timed Sessions
- Time begins when the session is activated and runs continuously, whether or not you are actively using the equipment.
- Unused time is not refundable and does not carry over to another session, another bay, another visit, or another customer.
- Add time before your session expires. If a session expires mid-wash, you must purchase a new session.
- We are not responsible for time lost due to your own delays, changing functions, moving the vehicle, or leaving the bay.
8.4 Foam Brush: Use at Your Own Risk
THE FOAM BRUSH IS USED BY MANY CUSTOMERS ON MANY VEHICLES. IT MAY RETAIN DIRT, SAND, GRIT, OR DEBRIS FROM PRIOR USE THAT CAN SCRATCH, MAR, OR SWIRL PAINT AND OTHER SURFACES. WE DO NOT INSPECT, CLEAN, OR GUARANTEE THE CONDITION OF THE FOAM BRUSH BETWEEN USES. IF YOU CHOOSE TO USE IT, YOU DO SO ENTIRELY AT YOUR OWN RISK AND WE ACCEPT NO RESPONSIBILITY FOR ANY RESULTING DAMAGE.
We strongly recommend flushing the brush with the high-pressure rinse before it touches your vehicle. Do not use the foam brush on matte or satin finishes, vinyl wrap, soft tops, or freshly painted surfaces.
8.5 High-Pressure Wand Safety
The high-pressure wand discharges water and cleaning solution at pressure sufficient to cause serious injury. You must NOT:
- Aim or spray the wand at any person or animal, including yourself
- Spray at your skin, face, or eyes, or at any body part of any person
- Spray into an engine compartment, air intake, exhaust, or any electrical component
- Spray through an open window, door, sunroof, or truck cab
- Spray at bay equipment, lighting, meters, signage, cameras, walls, or ceilings
- Spray outside the bay or toward adjacent bays, vehicles, or the parking area
- Allow children to hold or operate the wand
- Modify, disassemble, or attach anything to the wand or hose
8.6 Cleaning Solutions
Bay chemicals, including presoak, soap, wax, and tire cleaner, may cause eye and skin irritation. Avoid contact. Flush immediately with clean water on contact and seek medical attention if irritation persists. These solutions are not for use on skin, hair, animals, or any purpose other than vehicle washing.
8.7 Slip, Trip, and Weather Hazards
Bay floors are wet, soapy, and slippery by nature. Surfaces may freeze in cold weather. Hoses, wands, and equipment are trip hazards. Watch your footing, wear appropriate footwear, and move with care. You use the bays at your own risk.
8.8 Children and Animals
Children must be supervised at all times and must not operate any equipment. Keep children and animals clear of the wand, brush, moving vehicles, and bay entrances. Do not wash, spray, or rinse any animal in any bay.
8.9 Prohibited Uses
The following are strictly prohibited in Self-Serve Bays and anywhere on the property:
- Oil changes, fluid draining, radiator flushing, or transmission service of any kind
- Engine degreasing or any activity that discharges oil, fuel, antifreeze, solvent, or other automotive fluid to a drain
- Disposal of any liquid, chemical, trash, or waste in the bays, drains, or trash receptacles
- Painting, sanding, grinding, welding, or bodywork
- Washing engines, engine parts, machinery, equipment, tools, dumpsters, trash containers, or any non-vehicle item
- Washing or rinsing animals
- Operating a commercial detailing, mobile wash, or vehicle reconditioning business from our property without our prior written permission
- Bringing your own pressure washer, chemicals, hoses, or power equipment
- Overnight parking, camping, sleeping in vehicles, or loitering
- Vehicle repair of any kind
8.10 Personal Property
Do not leave tools, mats, wheels, personal items, or trash in a bay. We are not responsible for personal property left in, lost in, or damaged in any bay. Items left behind may be discarded.
Assumption of Risk
YOU ACKNOWLEDGE THAT VEHICLE WASHING, WHETHER AUTOMATIC OR SELF-SERVE, INVOLVES INHERENT RISKS TO YOU AND TO YOUR VEHICLE, INCLUDING RISKS FROM HIGH-PRESSURE WATER, CLEANING CHEMICALS, WET AND SLIPPERY SURFACES, MOVING VEHICLES, AND SHARED EQUIPMENT. YOU VOLUNTARILY ASSUME THOSE RISKS.
By using our facilities, you represent that your vehicle is in sound mechanical and cosmetic condition, that it complies with Sections 6 and 8, and that you are capable of safely operating the equipment you choose to use.
Damage and Injury Claims
10.1 Report Before You Leave
ALL CLAIMS FOR VEHICLE DAMAGE OR PERSONAL INJURY MUST BE REPORTED BEFORE YOU EXIT THE PROPERTY.
To report a claim: (1) Do not leave the premises. (2) Call the customer service number for the location you are at — Spring Cypress: 281-803-9325 · Louetta: 281-936-9515. These numbers are also posted at the pay station, at the Automatic Wash entrance, and in each Self-Serve Bay. (3) Remain on site so the vehicle, the bay, and the equipment can be inspected while conditions are unchanged. (4) Do not wash, repair, or alter the vehicle before inspection. (5) Seek immediate medical attention for any injury. Report the injury to us as soon as you are able.
10.2 Why This Matters
Once a vehicle leaves the property, we cannot verify the condition of the vehicle at the time of service, review the equipment against the vehicle's condition, or preserve the relevant video record. Claims first reported after you leave the property may be denied on that basis.
10.3 Video Record
Both locations are under continuous video surveillance. Video is retained for a limited period in the ordinary course of business and may be reviewed in connection with any claim.
10.4 What We Do Not Cover
We do not accept responsibility for damage to or loss of:
- Any item or condition listed in Section 6.2
- Damage arising from foam brush use (Section 8.4)
- Damage arising from your own operation of Self-Serve Bay equipment
- Pre-existing damage, wear, rust, corrosion, or deterioration
- Items left in, on, attached to, or towed by the vehicle
- Loss of use, rental costs, towing, diminished value, or any other indirect loss
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW: (A) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO ANY WASH, ANY SELF-SERVE BAY SESSION, ANY WASHBOOK, OR YOUR USE OF OUR PREMISES, INCLUDING ANY CLAIM BASED IN WHOLE OR IN PART ON OUR OWN NEGLIGENCE, IS LIMITED TO THE REASONABLE COST OF REPAIRING THE SPECIFIC DAMAGE WE ACTUALLY CAUSED. WE ARE NOT LIABLE FOR VEHICLE OR COMPONENT REPLACEMENT COST, FOR REPAIR OR REFINISHING OF ADJACENT OR UNAFFECTED AREAS OR PANELS, OR FOR ANY AMOUNT EXCEEDING THAT REPAIR COST.
(B) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, RENTAL CAR COSTS, TOWING, OR DIMINISHED VALUE.
(C) NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED UNDER TEXAS LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR PERSONAL INJURY OR DEATH CAUSED BY OUR NEGLIGENCE. NOTHING IN THESE TERMS WAIVES ANY RIGHT YOU HAVE UNDER THE TEXAS DECEPTIVE TRADE PRACTICES CONSUMER PROTECTION ACT.
Service Interruptions and Equipment Malfunction
12.1 Equipment Failure
If equipment fails to deliver the service you paid for, call the customer service number for that location before you leave the property: Spring Cypress 281-803-9325, Louetta 281-936-9515. For a failed Automatic Wash cycle, we will, at our option, re-run the wash or restore the redeemed wash to your Washbook Balance. For a Self-Serve Bay malfunction, we will, at our option, restore the equivalent session time or refund the session. This is your sole and exclusive remedy for a failed or incomplete service.
12.2 All Other Inquiries
Any question, concern, or complaint about a wash, including dissatisfaction with cleaning results, should be directed to the customer service number for that location (Spring Cypress 281-803-9325, Louetta 281-936-9515) or by email to [email protected]. We review these individually. Nothing in this section creates an entitlement to a rewash, refund, or credit outside of Section 12.1.
12.3 Downtime and Closures
We may close either location, or take any bay or service out of operation, at any time for maintenance, repair, utility interruption, severe weather, or safety. We are not liable for any loss or inconvenience resulting from a closure or from the temporary unavailability of any bay, service, or tier. Washbook washes remain valid and redeemable when service resumes.
12.4 Weather
No rain guarantee, rain check, or re-wash is provided based on weather. Once a wash is dispensed or a session is activated, it is considered delivered.
Vacuums
Vacuum stations are provided as a free courtesy, offered on an as-is and as-available basis, with no guarantee of availability or performance. Use is at your own risk. We are not liable for damage to vehicle interiors, upholstery, trim, or personal property arising from vacuum use, or for items lost in a vacuum unit.
Promotions and Discounts
- Promotional pricing and discount days are offered at our discretion and may be changed, limited, or withdrawn at any time without notice.
- Unless expressly stated, promotions cannot be combined with any other offer, discount, or Washbook redemption.
- Washbook washes are already discounted and are not eligible for further promotional discounts.
- Promotions apply only to the service and location or locations stated in the offer.
Conduct and Right to Refuse Service
We may refuse service, remove a person from the property, or cancel a Wash Code, with or without notice, for any of the following: unsafe operation of a vehicle or equipment, failure to follow posted instructions, damage to our equipment, any prohibited use under Section 8.9, abusive or threatening behavior toward staff or other customers, suspected fraud, chargeback abuse, attempted resale of Washbooks, or any unlawful activity on the premises.
Where a Wash Code is cancelled for fraud, resale, or chargeback abuse, any unredeemed Washbook Balance may be forfeited to the extent permitted by law.
Privacy and Video Surveillance
Both locations are monitored by video surveillance twenty-four hours a day for safety, security, and claim verification. By entering the property, you consent to being recorded.
Records associated with a Washbook purchase may include the mobile phone number you provide, your Wash Code and Washbook Balance, and payment card details as processed by our payment provider. We use the mobile number you provide to deliver Wash Codes and to service your Washbook. We do not sell it. See our Privacy Policy at www.cypresswash.com for details on how this information is handled.
Changes to These Terms
We may revise these Terms at any time. The version posted at the pay station and on our website at the time of your transaction governs that transaction. Continued use of our services after a revision constitutes acceptance of the revised Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, our services, or our premises shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction and venue of those courts.
Nothing in these Terms prevents either party from bringing a qualifying claim in a Texas Justice Court.
General
Severability. If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any provision is not a waiver of that provision.
Entire Agreement. These Terms, together with the posted wash menu, bay signage, and all other posted signage, constitute the entire agreement between you and Cypress Wash LLC regarding the purchase and use of our services.
Assignment. We may assign these Terms in connection with a sale or transfer of the business. You may not assign them.
